We act in different capacities depending on the type of data:

Data Processor/Hosting Role: For user-generated content (eMail-Shots, equipment listings, communications content), we act as a hosting platform. Members determine what content to upload and send - we merely provide the technical infrastructure.

Data Processors: We may use third-party service providers (such as hosting companies or email services) who act as data processors on our behalf. These processors only process data according to our instructions.

3. Information We Collect

As Data Controller (Member Database): 3.1 Business Registration Information: Company name, business address, business registration information, VAT numbers

3.2 Business Contact Data: Names, business phone numbers, and business email addresses of company representatives

3.3 Usage Data: How you interact with our Platform, including login times and features used

3.4 Technical Data: IP addresses, browser information, device identifiers, location data

As Data Processor/Host (User-Generated Content): 3.5 Equipment Listings: Content uploaded by members advertising equipment for sale

3.6 Email Communications: Content of eMail-Shots sent by members through our platform

3.7 Other Member Content: Any other information members choose to upload or transmit

Note: For user-generated content, members are responsible for ensuring they have appropriate rights to process any personal data they include. We process this content solely to provide hosting and transmission services.

4. How We Use Your Information

As Data Controller (Member Database): We process your registration and contact data for the following purposes:

4.1 Contract Performance: To provide Platform services and facilitate business-to-business member communications

4.2 Legitimate Interests:

• Platform security and fraud prevention
• Improving our services
• Investigating reported violations
• Facilitating genuine business communications in the materials handling equipment sector

4.3 Legal Compliance: Meeting our obligations under UK and applicable EU law

As Data Processor/Host (User-Generated Content): 4.4 We process user-generated content solely to provide hosting, transmission, and platform services as instructed by members

4.5 We do not monitor, review, or analyse the content of eMail-Shots or equipment listings

4.6 Members are responsible for the lawfulness of any personal data included in their content

Legal Basis: For business contact data that constitutes personal data, we rely primarily on legitimate interests for B2B communications, contract performance for service provision, and legal compliance where required.

5. Information Sharing

5.1 We share business contact details with other Platform members for legitimate business-to-business communication purposes within the materials handling equipment sector

5.2 Cross-border transfers: When sharing data between UK and EU/EEA members, we ensure appropriate safeguards are in place

5.3 We may disclose information to law enforcement when required by law in any relevant jurisdiction

5.4 Enquiry forms: visitors who use the Request a Quote, parts quote, Sell Your Equipment, Ask a Dealer and transport quote forms give us a company name, a contact name, an e-mail address and, if they wish, a phone number, together with their request. We pass these to the forktrucks.com members who cover the request (by category and, where the form asks for it, by location), so that they can respond directly; we cannot provide a list of the recipients. We keep a copy of each request for no longer than 36 months. We use these details for nothing else and contact the enquirer only about their request. Our legal basis is our legitimate interest in putting enquirers in touch with suppliers, and taking steps at the enquirer's request. Members who receive an enquiry are responsible for their own handling of it.

5.4 We do not sell personal data to third parties

5.5 All data sharing is limited to the business purposes for which members joined the Platform

6.1 Your data may be transferred between the UK and EEA as necessary for Platform operations

If you press Reject, or make no choice, these tags run without setting advertising cookies. Google and Microsoft process this information under their own privacy policies.

You can control cookies through your browser settings, but some Platform features may not work without essential cookies. To change your answer to our cookie banner, delete the forktrucks.com cookies in your browser and the banner will ask again.
